Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tekku platform, website, and related services (collectively, the "Service") operated by Tekku, Inc. ("Tekku," "we," "us," or "our"). Please read these Terms carefully before using our Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

If you are a parent or legal guardian creating an account or providing consent on behalf of a child, you represent and warrant that you have the legal authority to bind both yourself and your child to these Terms. Your use of the Service on behalf of a child constitutes your acceptance of these Terms for both you and the child.

2. Description of Service

Tekku is an educational technology platform designed for children ages 8–16 that teaches them to build with AI agents. The Service includes, but is not limited to:

• Mission-based learning: Structured, project-driven lessons that guide learners through progressively challenging AI building tasks.
• Glass Box:A transparent, step-by-step AI environment where children can see exactly how AI agents make decisions — no black boxes.
• AI Coach: A real-time AI assistant that provides hints, feedback, and encouragement as children work through missions.
• Builder profiles:Personal portfolios that track a child's progress, completed projects, and earned skills.
• Parent dashboards:A dedicated interface where parents can monitor their child's activity, review AI interactions, manage privacy settings, and view learning reports.

We reserve the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of material changes that affect your use.

3. Eligibility

The Service is designed for children ages 8–16. To use the Service, the following eligibility requirements must be met:

• Child users must be at least 8 years of age.
• Children under the age of 16 must have verifiable parental or legal guardian consent to use the Service.
• Parents or legal guardians creating accounts must be at least 18 years of age (or the age of majority in their jurisdiction).
• You must provide accurate and complete information during registration.

Tekku reserves the right to refuse service, terminate accounts, or restrict access at our sole discretion if eligibility requirements are not met.

4. Account Registration

To access the Service, a parent or legal guardian must create an account ("Parent Account"). By registering, you agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security and confidentiality of your account credentials.
• Promptly update your account information if it changes.
• Accept responsibility for all activities that occur under your account, including any activity by linked child profiles.
• Notify Tekku immediately of any unauthorized use of your account or any other breach of security.

You may not transfer your account to another person or entity. Tekku is not liable for any loss arising from unauthorized use of your account.

5. Children's Accounts and COPPA Compliance

Tekku is committed to protecting the privacy and safety of children online. We comply fully with the Children's Online Privacy Protection Act ("COPPA") and applicable international child privacy regulations. For full details, please review our COPPA Policy.

• Parental consent: We require verifiable parental consent before collecting any personal information from children under 13. Our consent process meets or exceeds FTC guidelines.
• Parent controls:Parents retain full control over their child's account through the parent dashboard, including the ability to review data collected, manage privacy settings, restrict features, and delete their child's account entirely.
• Dashboard access: The parent dashboard provides visibility into all AI interactions, learning activity, and content generated by a child on the platform.
• Data minimization: We collect only the minimum personal information necessary to provide the educational Service.

6. Subscription and Billing

Tekku offers the following plans:

• Explorer (Free): Access to a limited set of introductory missions and basic features at no charge.
• Builder ($29/month): Full access to all missions, the AI Coach, advanced builder profile features, and priority support.

Paid subscriptions are billed monthly through our payment processor, Stripe. By subscribing to a paid plan, you authorize Tekku to charge your designated payment method on a recurring monthly basis until you cancel.

Cancellation: You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have already paid for.

Refunds: If you are dissatisfied with the Service, you may request a refund within 14 days of your initial subscription or most recent renewal. Refund requests are handled on a case-by-case basis. To request a refund, contact us at legal@tekku.app.

Price changes:We may change subscription pricing at any time with at least 30 days' prior written notice. Price changes will not affect your current billing period.

7. Acceptable Use

You agree to use the Service only for lawful, educational purposes and in accordance with these Terms. You agree not to:

• Use the Service to create, upload, or distribute harmful, abusive, hateful, violent, obscene, or otherwise objectionable content.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code or underlying algorithms of the Service.
• Share account credentials with any third party or allow multiple individuals to use a single account.
• Use automated bots, scrapers, or other automated means to access the Service without our express written permission.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Attempt to gain unauthorized access to other users' accounts, data, or any part of the Service's systems.
• Use the Service in any manner that could damage, disable, or impair the Service or interfere with other users' use and enjoyment.

We reserve the right to investigate and take appropriate action against anyone who violates these guidelines, including suspension or termination of access.

8. AI-Generated Content

The Service uses artificial intelligence to provide educational content, feedback, and coaching. By using the Service, you acknowledge and agree to the following:

• Educational purposes: All AI-generated content is intended solely for educational use within the Tekku platform.
• No guarantees of accuracy: While we strive to provide high-quality, accurate content, AI-generated outputs may contain errors or inaccuracies. Tekku does not guarantee the accuracy, completeness, or reliability of any AI-generated content.
• Content moderation: All AI interactions are monitored and filtered through safety systems designed to prevent inappropriate, harmful, or off-topic content from reaching child users.
• Parental review: Parents can review all AI-generated content and AI interactions through the parent dashboard at any time. If you encounter content you find inappropriate or concerning, please report it immediately.

9. Intellectual Property

Your content:You retain ownership of all projects, code, designs, and other original content you or your child create using the Service ("User Content"). By using the Service, you grant Tekku a limited, non-exclusive, royalty-free license to display, reproduce, and distribute your User Content solely as necessary to operate and provide the Service (for example, displaying projects on a builder profile or rendering content within the platform).

Our content: The Tekku platform, including its design, branding, logos, software, educational content, mission structures, and all underlying technology, is the intellectual property of Tekku, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

10. Privacy

Your privacy and the privacy of your children are critically important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TEKKU DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR OWN RISK.

IN NO EVENT SHALL TEKKU, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF TEKKU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO TEKKU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tekku, Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service or any activity under your account.
• Your violation of these Terms or any applicable law or regulation.
• Your infringement or violation of any third party's rights, including intellectual property rights.
• Any User Content you or your child create or distribute through the Service.

13. Termination

Termination by Tekku: We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion.

Termination by you: You may cancel your account at any time through your account settings or by contacting us at legal@tekku.app. If you have an active paid subscription, cancellation of your account will also cancel your subscription effective at the end of the current billing period.

Effect of termination:Upon termination, your right to use the Service will immediately cease. We will delete your account data and your child's account data within 30 days of termination, unless we are required by law to retain it. You may request an export of your data prior to termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to the personal jurisdiction and venue of such courts.

15. Changes to Terms

We reserve the right to update or modify these Terms at any time. For material changes, we will notify you via the email address associated with your account at least 30 days before the changes take effect. We may also provide notice through the Service itself.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your account.
